1. INTRODUCTION
Welcome to Staypalm ("Staypalm", "we", "us", or "our"). These Terms of Use govern your access to and use of: • The Staypalm website • The Staypalm mobile application • Our short-term leasing marketplace • Our online store for electronic goods By accessing or using our Platform, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.
2. LEGAL STATUS OF STAYPALM
Staypalm operates as a digital marketplace connecting Guests and Hosts for short-term accommodation and as an online retailer and/or intermediary for electronic goods. Unless expressly stated otherwise: • Staypalm does not own or manage properties listed by Hosts. • Staypalm is not a party to rental agreements between Guests and Hosts. Lease agreements are concluded directly between Guest and Host.
3. ELIGIBILITY
Users must be at least 18 years old, have full legal capacity, and provide accurate registration information. Staypalm may suspend or terminate accounts for false or misleading information.
4. ACCOUNT SECURITY
Users are responsible for safeguarding login credentials and all activities under their account. Staypalm is not liable for losses resulting from compromised credentials due to user negligence.
PART A – SHORT-TERM LEASE SERVICES
5. BOOKINGS
Bookings may be made through the Platform or manually by contacting the Host via telephone or WhatsApp. Where bookings occur outside the Platform, Staypalm is not responsible for disputes, fraud, cancellations, or payment issues.
6. PAYMENTS
Payments processed through Staypalm must be made in South African Rand (ZAR). Service fees and applicable taxes may apply. Staypalm may cancel transactions suspected of fraud or irregularity.
7. CANCELLATIONS & REFUNDS (ACCOMMODATION)
Cancellation policies are set by Hosts and displayed on listings. Refunds are processed subject to the Host’s policy and applicable South African law.
8. USER CONDUCT
Guests must respect property rules, avoid unlawful conduct, and refrain from damaging property. Hosts must provide accurate descriptions and maintain safe, legally compliant premises. Staypalm may suspend accounts for violations.
9. DAMAGES & LIABILITY (ACCOMMODATION)
Guests are liable for damage caused during their stay. Staypalm may assist with dispute resolution but does not guarantee recovery of damages.
PART B – ONLINE STORE (ELECTRONIC GOODS)
10. PRODUCT DESCRIPTIONS
Staypalm makes reasonable efforts to ensure product accuracy. Errors, minor variations, and availability issues may occur. We reserve the right to correct errors and cancel affected orders.
11. ORDERS & ACCEPTANCE
An order constitutes an offer to purchase. A binding agreement arises only after payment is processed and order confirmation is issued. Staypalm reserves the right to refuse or cancel orders.
12. DELIVERY
Delivery timelines are estimates only. Risk transfers to the customer upon delivery. Staypalm is not liable for courier delays beyond its control.
13. RETURNS & WARRANTIES
Returns are subject to South African consumer legislation and manufacturer warranties where applicable. Statutory remedies apply for defective goods.
GENERAL PROVISIONS
14. INTELLECTUAL PROPERTY
All Platform content including logos, branding, software, text, and images is the property of Staypalm or its licensors and may not be reproduced without written consent.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Staypalm is not liable for indirect or consequential damages. We do not guarantee uninterrupted platform access and are not responsible for third-party conduct.
16. INDEMNIFICATION
Users agree to indemnify Staypalm against claims arising from breach of these Terms, misuse of the Platform, or violation of applicable laws.
17. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of South African courts.
